Terms of Service

1.  Agreement to Terms

By accessing or using ShiftTrained (the "Service"), provided by ShiftTrained, Inc. ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2.  Description of Service

ShiftTrained is an AI-powered menu training platform for restaurants.  The Service allows restaurant operators to upload menus, generate training quizzes using artificial intelligence, distribute quizzes to staff, and track training performance through a management dashboard.

3.  Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You must be at least 18 years old to create an account.
  • One person or entity may not maintain more than one free trial account.

4.  Subscriptions & Billing

  • The Service offers a free trial with full access.  No credit card is required to start.  The trial is value-gated, premium features activate upon subscribing to a paid plan.
  • After the trial, a paid subscription is required to continue using premium features.
  • Subscriptions are billed monthly or annually through Stripe.  Prices are listed on our pricing page.
  • You may cancel your subscription at any time.  Access continues until the end of the billing period.
  • We reserve the right to change pricing with 30 days' written notice.
  • Refunds are handled on a case-by-case basis.  Contact us within 14 days of charge for consideration.

If payment fails, ShiftTrained's payment processor will automatically retry the charge up to 4 times over the following 7 days using intelligent retry timing.  If all retry attempts fail, your account will be downgraded to free trial status after 14 days of non-payment.  Active quiz links will be deactivated until payment is resolved.  You will be notified by email of each failed payment attempt.  Promotional or discounted pricing is offered at ShiftTrained, Inc.'s discretion and may be modified or revoked with 30 days notice.

5.  Account Termination

  • You may delete your account at any time from Settings → Your Data.
  • Upon deletion, all your data is permanently removed within 24 hours of confirmation.
  • Active subscriptions are canceled immediately upon account deletion with no refund for the current billing period.
  • ShiftTrained reserves the right to suspend or terminate accounts that violate these Terms.

6.  Data Ownership

  • You retain ownership of all content you upload (menus, employee data, custom questions).
  • You grant ShiftTrained a license to process your content for the purpose of providing the service (AI parsing, question generation, quiz delivery).
  • This license terminates when you delete your account.
  • AI-generated content (quiz questions, study guides) is created for your use within the platform.

Service Improvement & AI Training

You acknowledge and agree that ShiftTrained may access, review, and analyze your menus, questions, quizzes, employee performance patterns, and platform usage in order to (a) provide customer support, (b) investigate technical issues, (c) test new features and experimental functionality, and (d) improve, train, and develop ShiftTrained's AI models, question-generation algorithms, and underlying machine learning systems.

When your data is used for AI model training or feature development, it is used in aggregated and de-identified form with all restaurant-identifying information removed before processing.  Identifiable Customer Data (your restaurant name, employee names, specific menu items tied to your brand) is never sold to third parties and is never shared with third parties for their own marketing, advertising, or commercial purposes without your explicit consent, except as required by law or as strictly necessary to provide the Service (e.g. payment processing through Stripe, email delivery through Resend, AI inference through Anthropic).

This provision is necessary to allow ShiftTrained to maintain, debug, and continuously improve the Service.  If you do not agree with this use of your data in aggregated/de-identified form for service improvement, your remedy is to discontinue use of the Service and delete your account from Settings → Your Data.

7.  Acceptable Use

  • You are responsible for the accuracy of employee information you enter.
  • You must have authorization to upload menu content.
  • You must not use the platform to distribute harmful, offensive, or illegal content.
  • You agree not to reverse-engineer, decompile, or hack the Service.
  • You agree not to use automated systems (bots, scrapers) to access the Service without permission.
  • You agree not to share your account credentials with unauthorized parties.
  • You agree not to resell or redistribute the Service without written consent.

8.  Content & Intellectual Property

Your Content

You retain ownership of all content you upload (menus, logos, brand assets).  By uploading content, you grant us a limited license to process, store, and display it as necessary to provide the Service.

AI-Generated Content Disclaimer

ShiftTrained's AI generates quiz questions based on uploaded menu text.  The AI does not have access to your kitchen, recipes, preparation methods, supplier specifications, or actual ingredient lists.  All quiz questions, particularly those involving allergens, dietary restrictions, ingredients, and preparation methods, must be independently verified by the restaurant against actual recipes and supplier documentation before use.  ShiftTrained is a training tool, not a food safety or allergen compliance system.  Restaurants are solely responsible for the accuracy of allergen and dietary information communicated to staff and guests.

Our Property

The ShiftTrained platform, brand, design, code, and documentation are the intellectual property of ShiftTrained, Inc. and are protected by copyright and trademark laws.

9.  Team Members

By inviting team members to your ShiftTrained account, you represent that you have the authority to grant them access and that you have informed them of these Terms of Service and Privacy Policy.  You are responsible for your team members' use of the Service within your organization.  Invited team members must independently agree to these Terms before accessing the platform.

10.  Account Sharing

Each account is for a single individual.  Manager seats are per-person and may not be shared.  Sharing login credentials with unauthorized parties may result in account suspension.  Each team member must have their own account with their own credentials.

What Messages Are Sent

Training-related text messages on behalf of the employee's employer.  Specifically: quiz invitations, reminders, and study guides.

How Employees Opt In

  1. A restaurant manager with a ShiftTrained account invites the employee to take a training quiz.
  2. The employee opens the quiz link and lands on the registration screen at /q/{slug}.
  3. The employee sees an optional SMS consent checkbox on that screen, unchecked by default and labeled “Optional · SMS Updates.”
  4. The Continue button is enabled at all times.  The employee may proceed to the quiz with or without ticking the SMS consent checkbox; SMS consent is not a condition of taking the quiz.
  5. If the employee ticks the checkbox and taps Continue, this constitutes affirmative consent to receive SMS messages.  The timestamp, the verbatim consent text shown at that moment, and the employee's IP address are recorded against the employee's record.
  6. If the employee taps Continue without ticking the checkbox, they proceed to the quiz but no SMS messages are sent to them.  The employee's manager continues to reach them via email only.

Message and data rates may apply.  Contact your carrier for details.  ShiftTrained does not charge employees for text messages.  ShiftTrained is not responsible for carrier delays or undelivered messages.

Opt-Out

Reply STOP to any message to opt out at any time.  After opting out, no further messages will be sent to that number.

Data Sharing

No mobile information, including phone numbers and SMS consent records, will be shared or sold with any third parties, affiliates, or lead generators for any purpose.  Text messaging originator opt-in data and consent will not be shared with any third parties.  Mobile information is used solely to deliver the training-related messages described in this section.

12.  Community Content

Users may post content to ShiftTrained's community hub.  By posting, you grant ShiftTrained, Inc. a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Service.  We reserve the right to remove any content that violates these Terms or community guidelines without notice.  ShiftTrained is not responsible for content posted by users.

13.  Employment Decisions

ShiftTrained is a training and knowledge assessment tool.  Quiz scores and performance data are provided for informational purposes only and should not be the sole basis for hiring, termination, promotion, demotion, or any other employment decision.  The restaurant assumes full responsibility for all employment decisions and compliance with applicable labor laws.

14.  Marketing & Publicity Rights

By using the Service, you grant ShiftTrained, Inc. a non-exclusive, royalty-free, worldwide license to use your restaurant's name, logo, brand assets, trademarks, and general use case to identify you as a ShiftTrained customer in any of the following:

  • Our website, including customer logo walls and case study pages
  • Marketing materials, sales decks, investor presentations, and pitch documents
  • Social media posts and stories (Instagram, X, Facebook, LinkedIn, TikTok, etc.)
  • Paid advertising (Google, Meta, LinkedIn, programmatic) and earned-media press
  • Customer testimonials, success stories, and quote-style attributions
  • Email newsletters, drip campaigns, and broadcast communications to other customers and prospects
  • The ShiftTrained community hub at /community and related public pages

This permission is granted by default upon account creation and does not require a separate signed agreement.  We rely on this clause to operate normal SaaS marketing activities common to the industry.

Opt-out: You may revoke this permission at any time by emailing hello@shifttrained.com with the subject line "Marketing Opt-Out." Upon receipt, we will remove your name and logo from new marketing materials within 30 days.  Existing printed materials, archived social media posts, and previously distributed assets may continue to display your information until they are naturally retired.

15.  Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16.  Liability

  • ShiftTrained provides AI-generated quiz content on an "as is" basis.
  • We do not guarantee the accuracy of AI-generated questions, managers are responsible for reviewing questions before sending quizzes.
  • We are not liable for training outcomes or employee performance.
  • Allergen and dietary information in AI-generated questions should be verified by the restaurant.

ShiftTrained is not liable for service interruptions caused by third-party providers including but not limited to Supabase, Stripe, Anthropic, Vercel, Resend, Twilio, or Cloudflare.  ShiftTrained does not guarantee any specific uptime percentage or service level agreement.

To the maximum extent permitted by law, ShiftTrained, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages.  Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

17.  Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  We do not warrant that the Service will be uninterrupted, error-free, or secure.

18.  Indemnification

You agree to indemnify, defend, and hold harmless ShiftTrained, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, (d) employment decisions made using data from the Service, or (e) any allergen, dietary, or food safety incidents related to information generated or displayed by the Service.

19.  Force Majeure

ShiftTrained, Inc. shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemics, internet or infrastructure outages, third-party service failures, government actions, or labor disputes.

20.  Service Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason with reasonable notice.  Upon termination, your right to use the Service ceases immediately.  You may export your data prior to termination from Settings → Your Data.

21.  Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.  Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Illinois.

22.  Changes to Terms

We reserve the right to modify these Terms at any time.  Material changes will be communicated via email or a prominent notice on the Service.  Continued use of the Service after changes constitutes acceptance of the updated Terms.
